A Study of Judicial Precedents Analysis of Elderly Sexual Abuse - Focusing on Criminal Judgments under “Welfare of Senior Citizens Act” -

Abstract

|
The purpose of this study is to understand the patterns of elder sexual abuse and suggest social work interventions and systematic changes by analyzing criminal judgments applying the Welfare of Senior Citizens Act. To achieve this, 16 relevant lower court judgments were analyzed, focusing on key issues such as judgments related to employment restrictions, the involvement of specialized elder protection agencies, and the examination of the contents of criminal acts.
The research findings indicate the following: 1) Employment restrictions based on the Welfare of Senior Citizens Act were infrequently applied; 2) The involvement of specialized elder protection agencies was primarily observed in cases of institutional abuse; and 3) Analysis of the content of criminal acts revealed a diverse range of types and extents of elder sexual abuse. Based on these findings, the study proposed improvements to support system for specialized elder protection agencies, legal amendments involving aggravated punishment, and the establishment of collaborative systems with relevant organizations.
